1. Introduction

These terms and conditions (“Terms”) govern your use of the IBV Prive Bakery website and services and apply to all online orders placed for delivery or collection. By using our website, browsing our content or purchasing products, you agree to these Terms, our Privacy Policy , and all other notices posted on our website.

 

2. Definitions

2.1. “IBV Prive Bakery” – refers to the digital storefront and operations of (INSERT HOLDING COMPANY)

2.2. “Customer” – means any user, purchaser, or visitor who accesses the website and/or places an order online, telephonically, or in person.

2.3. “Products” – includes all items sold by IBV Prive Bakery including, but not limited to, cakes, pastries, breads, desserts, and packaged goods.

2.4. “Website” – means (INSERT OFFICAL WEBSITE HERE) or any subdomain managed by IBV Prive Bakery.

2.5. “Working Day” – means Monday through Friday, excluding public holidays.


3. Scope Of Services

3.1. Customers may browse, select, and purchase our products through:

3.1.1. Our online platform;
3.1.2. Telephonic orders;
3.1.3. In-store orders (reserved for Wealth Club Members only)

3.2. Orders may be placed for:
3.2.1. Scheduled local delivery within designated service areas;
3.2.2. In-store pickup;
3.2.3. Event and catering services, subject to advance booking and custom arrangements.

3.3. All products are subject to availability and seasonal adjustments. Orders are only confirmed upon successful payment and issuance of official confirmation via email, Whatsapp, or written receipt.

 

4. Product Information and Allergen Disclosure

We strive to ensure that all our product descriptions, images, and information are accurate. However, variations in size, appearance, and decoration may occur.

All products are prepared in a facility which handles nuts, gluten, dairy, soy, eggs and other known allergens. It is the customer’s responsibility to review all ingredients prior to placing an order. Should you have specific dietary needs or allergies, please consult with our staff prior to ordering.

 

5. Ordering and Payment

5.1. Orders may be placed online via our website, in person, or telephonically. Full payment is required at checkout, unless otherwise arranged in writing.

5.2. Accepted payment methods include:
• Major credit/debit cards;
• EFT;
• Cash

5.3. Prices are displayed in ZAR (South African Rand) and include VAT.

5.4. We reserve the right to reject, cancel, or refund any order due to error, unavailability, or suspected fraud.

5.5. Custom and event orders may require a partial or pre-payment as per our quotation. Orders are only confirmed upon receipt of proof of payment and issuance of confirmation.

 

6. Delivery & Collections

6.1. Delivery is available within designated regions and time slots. Delivery fees may apply based on distance and order value, which will be communicated to the customer in advance.

6.2. Estimated delivery times are for use as guidance only. Delays may occur due to weather, traffic, load-shedding, or courier availability.

6.3. Customers are required to ensure that someone is available to accept the delivery of their order, at the delivery address.

6.4. For in-store collections, customers will be notified via email, SMS, Whatsapp or telephonically when their order is ready for collection. Unclaimed orders are non-refundable.

6.5. Once a product has been collected or delivered, IBV Prive Bakery accepts no responsibility for any damage or spoilage to the product thereafter. Customers are advised to transport the goods with care.

6.6. Ownership and risk of the products pass onto the customer upon successful delivery or collection.

 

7. Order Modifications & Cancellations

Due to the perishable and handcrafted nature of our products:
7.1. Orders may only be cancelled or modified within 6 hours of placement. After this window, cancellations are not guaranteed and may incur costs.

7.2. Custom and event orders require a minimum of 48 hours’ notice for any changes or cancellations.

7.3. Special and customized orders require a minimum of 2 weeks’ notice for any rescheduling or modifications.

 

8. Refunds & Returns

8.1. We take pride in our craftmanship. If a product is incorrect, damaged, or unsatisfactory:
• Notify us within 24 hours of delivery or collection;
• Provide clear photographic evidence;
• Submit a refund request via email, WhatsApp, or in person

8.2. Refunds will be considered if at least 50% of the original product is returned intact. Each complaint and refund request will be assessed on its own merits and at our sole discretion.

8.3. Approved refunds may be processed as store credit, replacement, or bank transfer at our sole discretion. Refunds are not offered for taste preference, delayed collection, or improper customer handling. No refunds will be issued after order completion except in cases of verified defects.

 

9. Storage & Consumption

All products are best enjoyed fresh and should be consumed within their labeled shelf life. Products requiring refrigeration must be stored below 5 °C. Once a product is opened or cut, items should be consumed promptly. We will not be held liable for any adverse effects resulting from the improper handling or late consumption of our products.

 

10. Intellectual Property

10.1. All content, recipes, packaging designs, and trademarks are the exclusive property of IBV Prive Bakery. Reproduction, distribution, or use without our prior written consent is prohibited.

10.2. User-generated reviews, photos, or messages may be used in future marketing unless the customer explicitly opts out.

 

11. Liability Disclaimer

To the fullest extent permitted by law:

11.1. IBV Prive Bakery disclaims all warranties, either express or implied.

11.2. We are not liable for any damages arising from delays, inaccuracies, non- deliveries, or defective goods -except as required by law.

11.3. Total liability, if any, shall not exceed the purchase price of the affected item(s).

 

12. Privacy, Cookies & Popia Compliance

12.1. IBV Prive Bakery complies with the Protection of Personal Information Act (POPIA). Personal data is used for fulfilment, service, and marketing purposes.

12.2. Use of our website implies consent to cookies and similar tracking tools. Users may opt-out of marketing or request data access/deletion via email.


13. Seasonal Products & Availability

Seasonal availability may affect certain items. Substitutions may be made with similar items of equal or greater value.

 

14. Force Majeure

14.1. IBV Prive Bakery shall not be liable for any failure or delay in the performance of its obligations under these Terms if any such failure or delay is caused by circumstances beyond its control, including but not limited to:

14.1.1. Acts of God, such as fires, floods, earthquakes, or other natural disasters;

14.1.2. Epidemics, pandemics or other public health emergencies; 14.1.3.Acts of war, terrorism, civil unrest, strikes, labor disputes, or sabotage;
14.1.4. Power outages, load-shedding, or failure of electricity, telecommunications, internet or postal services;

14.1.5. Failure of third-party suppliers, transport providers, or delivery partners;

14.1.6. Changes in law, government regulations, or restrictions which impacts fulfilment or operations.

14.2. In such events, we will use reasonable efforts to mitigate the impact and resume performance as soon as possible. Customers will be notified of any material delay or interruption. Should any of our fulfilments become impossible, the customer will be entitled to a full refund or credit at the discretion of IBV Prive Bakery.
